Ronan Mullen complains the Referendum Commission is doing its job

Referendum Commission ‘must protect its independence’ 
 
Commission mustn’t ‘jump for every hare’


The Referendum Commission should avoid being ‘unduly reactive’ to media queries if it is to protect its role as an independent advisor to the public in the marriage referendum debate, Independent Senator Rónán Mullen has said. 

Senator Mullen was responding to an Irish Times report that a ‘No’ campaign poster on surrogacy had “prompted the Referendum Commission to consider issuing a statement clarifying surrogacy as it relates to the same sex marriage referendum.”

“It appears that the Referendum Commission said it had received ‘loads’ of complaints about a particular poster,” Senator Mullen said. “It was reported as saying that it ‘would not penalise a particular group for disseminating false or misleading information’.”

“Getting into the business of confirming ‘loads’ of complaints risks suggesting that such complaints may be warranted without actually saying it,” Senator Mullen said.

“The Referendum Commission mustn’t allow itself to be captured in any way by campaign groups,” Senator Mullen said. “Campaigners may seek to create the impression that the other side’s arguments play fast and loose with the truth. Lodging complaints with the Commission with the media then asking if there have been complaints could be part of such a strategy. By jumping too quickly to every media hare, the Referendum Commission could unwittingly help create headlines that mislead the public,” Senator Mullen said.

“I think the Referendum Commission needs to observe the debate with intense fairness. Where particular issues become the focus of genuine controversy, it must supply factual information. And the Commission’s information must not just be the truth, but the whole truth. It must be comprehensive enough to recognise the different possible outcomes when the precise future legal situation on an issue may be a matter for debate - as in the case of surrogacy,” Senator Mullen said.

“As with our courts, the Commission mustn’t just be impartial, it must be seen to be impartial. It must protect its independence. It mustn’t be unduly reactive to media queries where too hasty a response could co-opt it to one side of the debate,” Senator Mullen concluded.
