+The New York Times reports on how a new trend in Corporate America should make the hairs on your neck stand at attention. As explained in this piece by reporter, Stephanie Strom, General Mills has initiated the equivalent of 'forced arbitration' on unwitting consumers of their products. It will not be long before other corporations test these waters. Apparently, the company has updated their 'Privacy Policy', common on websites or in other social engagement platforms to include limitations on rights and remedies. Taken to a logical extreme, a simply "Like", "Share" or downloading of a coupon could result in the consumer having no remedy other than  forced arbitration or some other settlement process via e-mail. This is arguably the antithesis of social media and the corporate goodwill that these platforms thrive on creating viral success. Hopefully, this will not be lost on those that see the article or sharer related posts. This development should be carefully monitored as it is sure to spawn imitators and be tested in courts across the U.S.. Would you think you or your social media savvy spouse, or child, are giving up legal rights by simply sharing giving out a "Like"?
The food company General Mills added language to its website to alert customers that they cannot take legal action against the company if they download coupons, enter a contest or connect with it in other ways.

Following a 2 month trial, a federal court jury entred a verdict for $9B against #Takeda Pharmaceutical Co. and Eli Lilly & Co.. over their diabetes drug - #ACTOS. Details fom the trial are forthcoming and expected to shed more light on how the companies hid risks from consumers and prescribers of a link to bladder cancer. Clearly, this verdict is a one-sided result and speaks volumes with regard to how the evidence was interpreted and allegations the companies placed profits over safety at the forefront of this Blockbuster drug. 
Takeda Pharmaceutical Co. and Eli Lilly & Co. were ordered to pay a combined $9 billion in punitive damages after a federal court jury found they hid the cancer risks of their Actos diabetes medicine in the first U.S. trial of its kind.

+Toyota USA has hopefully learned from the sudden acceleration investigation that the truth eventually comes out despite efforts to literally, in this case, sweep it under the floor mats. We have Toyota's at home and believe they make a good product, but this chapter in their history is one we will remain mindful of for some time.

Johnson & Johnson has been accused of losing or destroying evidence that impacts pending pelvic mesh cases. With the potential of a Department of Justice investigation looming their Era of Recalls will not be quickly forgotten by consumers or victims. Verdicts in these cases have gone both ways - to date - however, this new development opens a new front where executives and others will be wringing their hands and wondering where those that washed their hands years ago are today.

+The New York Times article revisits a December 2013 single care accident and law enforcement findings as the #recall probe widens and information evolves. #GM may have known in 2001 about problems, earlier than previously reported and counted the number of deaths incorrectly. Consumers were exposed to vehicles as original purchasers or renters in rental fleets. Information and reports continue to emerge and shed light on what appears to have been a problem for more than a decade only further underscoring: When did they know, or when should GM have known, there was a potential problem? Finally, why has it taken so long to act?

+Stryker Orthopaedics has reporteldy settled a handful of pending lawsuits arising out of their now +recalled Rejuvenate & ABG II modular hips. The once popular hips were recalled over fretting, corrosion and higher than anticipated failure rate that was linked to complications and the need for revision surgery in patients. +The New York Times explores how a FL expert found evidence that +General Motors had "quietly" changed the ignition switch in production vehicles without recalling vehicles already sold and on the road. Continued reports, and yet more #recalls, raise yet more questions about the failure to act and warn consumers and the public about the alleged defect. Doubtful this ends well for the company based upon one-sided reports that continue to emerge.
