Nokia and Ericsson seek to justify their #privateering ways, defend patent transfers to NPEs http://bit.ly/1PyJkfp #patenttrolls #frand
The debate over privateering (patent transfers by large operating companies to so-called non-producing entities or patent assertion entities) is in full swing, and it will be with us for a while. The week before last I made a call for input in an effort to build a smartphone-related privateering ...

I get your points but Apple are hardly a willing licensee in any sense. They have one of the most profitable segments and yet they feel no need to pay for what they take. I am not surprised it has come to this... They use the system to their advantage yet you have issues with others doing the same ?  I don't particularly like what is going on but "I" am not surprised.

#Copyright in declaring API code: here's why I don't have any competition concerns (Oracle v. Google) http://bit.ly/1EKOsBA #software #java
Reuters' Dan Levine, a world-class court reporter, has just published a story on what's going on behind the scenes of the U.S. government's decision-making ahead of its Supreme Court brief in Oracle v. Google. Mr. Levine's article says both parties recently argued their position to the U.S. ...

How much leverage will #Ericsson gain over #Apple with its European #patent infringement actions?  http://bit.ly/1F1cHyN it'll take time
On Friday, Ericsson announced the filing of " suits in Germany, the United Kingdom and the Netherlands against Apple's products" because negotiations in a global patent license have not resulted in a deal in more than two years but Apple "continues to sell products, for which its licenses have ...

Promise of union recognition insufficient to solve conflict at European Patent Office: new protests  http://bit.ly/1OHI0WT #epo #suepo
By promising (after approximately four decades) formal recognition of EPO staff unions, the Administrative Council of the European Patent Organisation extended an olive branch, presumably due to a combination of political (with some key member states increasingly hesitant to support EPO ...

The #Google that has joined Via Licensing's #LTE pool is the real Google--not the #FRAND abuser  http://bit.ly/1yi4Kpa #standards #patents
Yesterday's announcement that Google has agreed to make its LTE (4G) standard-essential patents, all or most of which previously belonged to Motorola, available through Via Licensing's LTE patent pool, is for all intents and purposes more meaningful than most settlements of patent disputes ...

In post-Alice world, weaker software #copyright would harm the U.S. economy: Oracle v. Google http://bit.ly/1FcjFAM #android #java #scotus
The three branches of the U.S. government--legislative, executive, judiciary--have all become aware in recent years of the negative effects of overprotection of software-related intellectual property. When too much leverage is given to right holders (especially those whose patents are dubious), ...

In early December, the United States Court of Appeals for the Federal Circuit held a hearing on Samsung's appeal of the final district court judgment awarding Apple $929 million in damages (but no injunction) in the first California case between these two parties. At the time the possibility of ...

Privateering: let's name and shame companies that feed patent trolls -- please help complete the list  http://bit.ly/1EvIdlT #patenttrolls
Privateering--the act of large companies giving patents to patent assertion entities (PAEs)--is (unfortunately) not illegal (yet), but it is abusive, antisocial behavior. It pollutes the legal environment and harms the economy. It has nothing to do with protecting legitimate innovation: ...

Ericsson's pseudo-sale of #patents to Unwired Planet and the rampant problem of privateering  http://bit.ly/1GeoHgD
In the first half of this decade, the biggest and most divisive issue in the information and communications technology (ICT) was FRAND: fair, reasonable and non-discriminatory licensing of standard-essential patents (SEPs). That issue hasn't gone away completely. Courts and regulators provided ...

Appeals court not inclined to toss $14.5 million FRAND breach verdict against Google's Motorola  http://bit.ly/1yY1bzi #standards #patents
More than 4½ years after Microsoft sued Motorola for not renewing a license agreement (a renewal that would likely have been costly after Motorola stopped making Windows devices), Motorola still hasn't paid Microsoft a dime in patent royalties on its Android devices, and for now there's no ...

Administrative Council offers ' formal recognition of the trade unions within the EPO's legal framework' http://bit.ly/1M9oZva #suepo #epo
My hopes for some progress resulting from this week's meeting of the Administrative Council (AC) of the European Patent Organisation (EPOrg), the multinational body that runs the European Patent Office (EPO), haven't been exceeded by much, but I'm not disappointed either.
