Nestlé loses bid for EU protection of its KIT KAT four-finger bar shape. After nearly a decade of attempting to trademark the KIT KAT product shape, which was heavily opposed by the rival owners of Cadbury, the European Court of Justice ruled against Nestlé, concluding that the shape was not sufficiently distinctive for trademark protection.
