Interesting isn't, how even the events of an issue can be open to interpretation? I kind leaned towards mind control because Max has used it in the past, and it seemed like a good way to betray his partner (who couldn't pull the trigger), and it felt like way too drastic of a turn for Jason Aaron to have Toad suddenly beating on kids (at least in this series) I was expecting a happier ending, and it seemed like Toad was just about to go into hero mode. Looking at it again right now, I also really see what you're saying, about giving up after being rejected, showing his true colors, and taking a villainous arc.
