Two recent cases from opposite sides of the country have me thinking. The first is the Garcia v. Google case from the 9th Circuit (http://law.justia.com/cases/federal/appellate-courts/ca9/12-57302/12-57302-2015-05-18.html) the Second is the 2nd Circuit case from last week 16 Casa Duse v. Merkin (http://law.justia.com/cases/federal/appellate-courts/ca2/13-3865/13-3865-2015-06-29.html) They both reach interesting conclusions about the singularity of copyright in a collaborative work, namely a motion picture.

What I'm starting to form as a clarified thought from the results of these two, admittedly fresh cases is this: Collaborative works that join "non-freestanding contributions" do not have independently copyrightable joined elements, so, unless there is a legitimate joint authorship arrangement between the collaborators, only the dominant collaborator will retain copyright in the completed whole.

This still leaves the question of the incomplete works that never reach a singularity. What's the status of all the parts? Who knows.

The one specific conclusion I draw-- which, to be honest, has always been resolute with me-- is this: ALWAYS GET A CONTRACT SETTING THE TERMS BETWEEN PARTIES BEFORE MOVING FORWARD. In both these cases and countless others, it would save untold thousands of unnecessary court expenses.
