- Until we begin to fine/recall/etc Judges for abuse of discretion this will continue to occur. Even then? Judges review other Judges for abuse of discretion, so you would need to insert some sort of grand jury like system in place to handle reform in how that is determined.
Even then? Judges are lawyers, and the Bar Association handles disciplining lawyers for professional ethics issues in Washington State.

- The entire game is rigged to circumvent public input and approval. Just like cabinet positions, czars, executive orders and executive memoranda. And the problem isn't even REALLY the executive and judicial branches: it's the legislative branch, which is supposed to be the strongest of the three, but which is composed of spineless idiots. If the legislative did it's job (or barring that, if they stopped the other two branches from taking powers that don't actually belong to them), the country would be far better off.
Of course, the country would ALSO be far better off if the entire government took every other year off, as they do in at least one state.39w
