As previously posted, if a home loan modification has not been accomplished in direct negotiations with the mortgage company, the mortgage company may be compelled, at least in the Detroit bankruptcy courts, to consider one.

Second mortgage lien stripping is very successful if there is an appraisal supporting the value of the home as less than the balance owed on the first mortgage. The second mortgagee in this circumstance is unlikely to fight the strip of its lien in bankruptcy court.

Independent studies have indicated that eighty-six percent (86%) of individuals who filed a chapter 7 bankruptcy and received a discharge of their debts had received at least one offer of credit within one year after their discharge. Twenty-four percent (24%) received an offer of credit from one of the listed creditors in their case.

Mr. Schneider maintains his law practice at the Law Office of Charles J. Schneider, P.C. in Livonia, Michigan, where he has worked exclusively in the field of consumer bankruptcy since 1984. He manages an exclusive practice averaging 30 chapter 7 and chapter 13 consumer bankruptcy cases per month. Mr. Schneider has been certified and re-certified in consumer bankruptcy by the American Board of Certification sponsored by the American Bankruptcy Institute since 1995. Mr. Schneider received his B.A. and his J.D. degrees from Wayne State University in Detroit, Michigan. He is a member of the State Bar of Michigan and is admitted to practice before the U.S. District Courts in the Eastern and Western Districts of Michigan, the U.S. Sixth Circuit Court of Appeals and the United States Supreme Court. Mr. Schneider is a member of the National Association of ChapterThirteen Trustees (NACTT); the Detroit, Livonia, and Oakland County Bar Associations; Consumer Bankruptcy Association; National Association of Consumer Bankruptcy Attorneys; and the American Bankruptcy Institute (ABI). Mr. Schneider has been a contributing author to ICLE's "Handling Consumer and Small Business Bankruptcies" since 2009. He is also a contributing author to the Inside The Minds series of the Thomsom Reuters/Aspatore publications "Strategies For Consumer Bankruptcy Appeals:The Nuances of the Consumer Bankruptcy Appeal Process" and "Best Strategies For Filing Chapter 13:The Cases, Clients and Challenges Of Filing a Chapter 13: A Foward Looking Approach." He has a peer review rating of AV in bankruptcy by Martindale-Hubbell from 2010 through 2014. He has an AVVO.com peer review rating of 10.0 of 10.0 from 2010 through 2014.
