Probate is the process undertaken to deal with a deceased persons estate i.e. assets and liabilities.

The term probate is used in a general sense but in fact only relates to a situation where the deceased has made a Will. If the deceased has not made a will, they are said to have died intestate and we deal with that situation in a separate article.
So when the deceased has made a will, the application to the probate office is for a grant of probate  to be issued.

The person authorised to apply to the probate office for the grant of probate is the executor as named in the will. The executor will generally engage a solicitor to carry out the process in obtaining a grant of probate. The solicitor will firstly review the will and ensure all is in order. It may be the case that ancillary Affidavits from Witnesses to the will or from Doctors who treated the Deceased may be required depending on circumstances. Again we will touch on this in a later article.

The next stage is to collate a list of all of the deceased's assets and liabilities. Real property will be valued by a valuer/ auctioneer, bank account balances will be obtained etc. Once these details are to hand, a form called a CA24 (Inland Revenue Affidavit) is completed which lists all of the assets and liabilities, the executor and the beneficiaries in the estate.  It also serves the dual purpose of identifying any Capital Acquisitions Tax (CAT) payable by the beneficiaries .    

Ancillary documentation will also be lodged with this CA24 form being the Oath for Executor, Copy Oath, Original Death Certificate , relevant Affidavits etc. The probate office will review the documentation and if in order will issue the Grant of Probate.
Once the grant is issued, the solicitor can then apply to have funds held in bank accounts released to the estate, can sell property in the estate or transfer property to beneficiaries.

A final administration account will be prepared by the solicitor, reviewed by the executor and inheritance tax discharged where appropriate.
