Former Uber driver, Syed Abid Muzaffar, was tried and convicted last week for the charge of vehicular manslaughter arising out of the December 31, 2013, death of 7-year-old Sophia Liu as she was walking home from her grandmother’s. http://bit.ly/2vv85Du

On August 2, 2018, former Uber driver Syed Abid Muzaffar was found guilty of vehicular manslaughter by a jury of 12 San Francisco citizens in the death of Sofia Liu. Muzaffar, while driving his vehicle on the evening of December 31, 2015 at the intersection of Polk and Ellis streets in San Francisco, turned right hitting Sofia, her mother and her brother who were crossing legally in a pedestrian crosswalk, crushing Sofia to death with his vehicle. Muzaffar was working as an Uber driver at the time of the incident.

California Vehicle Code regulations apply to all drivers, whether or not they are acting in a law enforcement or other public capacity. The only exception to that rule is provided in the CVC Section 21055, and applies when an authorized emergency vehicles are responding to an emergency call or fire alarm, engaged in rescue operations or in immediate pursuit of an actual or suspected violator of the law. http://bit.ly/2veYf8w

Arbitration agreements, simply are an alternative manner in which to resolve disputes outside of a courtroom, the employer and the employee “agree” to resolve any disputes privately, in the presence of an arbitrator (typically a retired judge), who then makes a binding decision on the matter.

The death of Jahi McMath has not ended the controversies surrounding brain death. An international debate is ongoing in the medical and scientific communities about whether brain death can be determined using antiquated testing while a patient is suffering from acute trauma. Doctors should not be able to use the brain-death diagnosis to do what they think is best. This strips the rights of the patients and families.

According to the California Department of Insurance, 18,465 homes and 2,586 businesses were destroyed in October’s North Bay firestorm. Public policy and market dynamics will determine how these enormous losses are ultimately apportioned among victims, insurance companies, government agencies, parties found liable for causing the blazes, and the public at large. http://bit.ly/2tEsnt8

California has long set very clear requirements for pool safety, embodied in the Swimming Pool Safety Act, California Health and Safety Code. As of January 1, 2018, the state legislature has updated these requirements in the hopes of further reducing home pool drownings.

The California Department of Forestry and Fire Protection (CalFire) recently released two investigative reports into PG&E’s responsibility for the October fires. The first was released on May 25 and covered four fires; the second came out on June 8 and covered another twelve, CalFire found every one of them to have been started by PG&E power equipment, with eight including the Atlas Fire resulting from utility code violations. http://bit.ly/2K8qQBV
