"Is there a difference between divorce vs. family law"

The terms divorce and family law are often used interchangeably, but they can actually mean different things in practicality. Family law is a broad area of law that covers many legal areas in addition to those that are associated with the divorce process such as adoption, guardianship, and conservatorship. Divorce law is actually a subset of family law. While many attorneys who handle divorces may also have expertise in other areas of family law, this isn't always the case.

"What you need to know about fathers' rights"

The state of California recognizes non-traditional family structures and provides fathers with certain child custody and visitation rights. Family courts value positive father-child relationships and want to make sure that children continue to have a productive and enriching relationship with their fathers. However, there's still a great deal of misinformation about the rights of fathers when it comes to custody and parenting time.

"Cyberstalking and divorce"

Cyberstalking occurs when an individual is using social media to intimidate, defame, or harass you. Examples would include hacking into your social media accounts and posting hostile, slanderous, or even threatening messages. Spouses going through the divorce process may spy on each other through social media in order to gather information or evidence needed to build a case. But, if cyberstalking is involved, it could be considered to be a form of domestic violence.

"Establishing paternity"

Due to advancements in technology, it's become increasingly easier to establish paternity through the use of DNA. All it takes is a swab of the inside of the mouth to procure a sample of DNA from the cheek cells of the individual in question and the child. Paternity can still be determined via a blood test as well as through the use of additional evidence.

"Mediation and your assets"

A mediation means that you and your spouse are choosing to work collaboratively with respect to your divorce proceedings. You may choose to retain you own independent attorney in a mediation as well. "How does a new change in the tax law affect divorce cases?"

As of January 1st, 2019, alimony deductions will expire due to a new change in the tax law. After the first of the year, the law will now require the payer of alimony to pay the taxes on that income rather than shifting the tax burden to the recipient. Therefore, divorcing parties will be better off, financially-speaking, if they can finalize their divorce judgment before January 1st.
