apple went with litigate instead of innovate and it cost them revenue and name branding
The number of smartphones that Apple has sold so far is nothing compared to how many they will sell in emerging world markets. 
Free trade and competition have finally caught up to Apple. You can't rest on your laurels in the tech industry, and just adding a few more bells (not so much whistles) to a phone and then overcharging for it isn't a business model that is going to keep you at the top forever.
