Judgment in the Court of Protection case of Paul Briggs and others, whether clinically assisted nutrition and hydration (CANH) should continue, has been released. The judge weighed the very strong presumption in favour of preserving life against the great weight to be attached to what Mr Briggs, who lacks capacity, would have decided if he had the capacity to do so, concluding that he would not have consented to CANH treatment continuing (what he would have thought was in his own best interests). Therefore, the judge decided it would not be in Mr Briggs' best interests under the Mental Capacity Act 2005 to give that consent - http://bit.ly/2iczeC5
