MINOR INJURY GUIDELINE(MIG) THE GOOD AND THE UGLY

The Minor Injury Guideline also known as MIG is a policy that is used when dealing with a victim’s minor injury claim. MIG’s purpose is to swiftly grade an accident victim’s injuries to help determine what financial compensation can properly rectify the injuries that the victim has suffered. MIG is viewed by the victim’s insurance company during their Accident Benefits claim process.

Pokémon GO Is Becoming A Driving NO!

Pokémon Go is taking the world by storm with its augmented reality monster hunting app, but is it making Toronto’s streets a more dangerous place to drive?

Pokémon Go for those who do not know is a mobile game/application that allows players to venture around the real world hunting digital monsters on their phones. The goal of Pokémon Go is to catch all 151 monsters. Which means exploring around the city multiple times before one can truly become a “Pokémon Master”.

People are taking Pokémon Go to another level of extreme and thus putting themselves and others in dangerous situations: pedestrians have been struck by cars while living the “Pokémon Master” dream and ignoring their surroundings; Cyclists and Motorists seem to be just as careless when it comes to getting distracted behind the wheel with this virtual app.

PERSONAL INJURY DOCUMENTS: OPINION LETTER

During your personal injury claim process you will be asked to work with multiple parties to help strengthen your case. Working in unison with these parties you will gather a large variety of documentation including information about your accident and your physical and physiological state. One of the more common documents that a personal injury lawyer may request from you is an Opinion Letter.

WHY ONE SHOULD OBTAIN A LAWYER FOR YOUR PERSONAL INJURY LAW SUIT

If you sustained injuries from a car accident, retaining a lawyer for your personal injury law suit is highly recommended. Many people do not realize the complex and lengthy process pursuing a personal injury suit is.

For one, lawyers will know all the necessary deadlines with respect to your claims for both accident benefits and tort. For example, from the moment your insurance company sends you an auto insurance claim form “OCF-1 form”, you may not even know what it is in the first place nor when you need to submit it back to insurance. You may not know what your rights and obligations are when a treatment plan is denied. You may try to fight an insurance company on it, but lawyers posses more knowledge and expertise with respect to challenging the other side and backing up their arguments – such as with case law. Accident lawyers are familiar with cases in their particular field, and will know when to use them. Moreover, when it comes to pursuing your tort claim, against the party that caused the accident, you may not know that you have two years to pursue your claim from the moment the injuries are discoverable. Even further, you may not even know that in certain cases, if you have discovered your injuries after the two year deadline, you may be able to persuade the judge to pursue your claim. This does not occur often, but may be a useful tool depending on your individual case.

THE ONTARIO GOVERNMENT’S PLAN FOR A FRAUD-OFFICE

Especially with the recent developments regarding car insurance fraud in Ontario, it is not surprising that the government recently announced their plans to develop a “fraud office” to help combat this growing problem. The damning video submitted by Aviva, which shows hidden camera footage of a physiotherapy clinic colluding with undercover Aviva employees has led to 3 people being charged with criminal fraud.

DRIVING WITH YOUR PETS

There are several Ontario laws that you need to be aware of if you are driving your pet in a car. For example, section 112 of the Highway Traffic Act, or the ‘insecure load’ section, does not specifically deal with animals but rather insecure loads. Essentially, all loads must be bound and secured. In the context of animals for example, dogs are not allowed to be loose in the back of a truck or a pick up. Animals need to be secure by way of a crate, which itself also needs to be secured.

PARALEGALS VS. PERSONAL INJURY LAWYERS

You’ve been injured in a car accident and are looking to hire a professional to help you with you with your accident benefits and tort claims. Many have wondered what the differences between paralegals and lawyers are and what authority a paralegal has to assist them with their case.

Like accident lawyers, paralegals can offer legal services in a number of legal fields, such as Small Claims Court cases, tribunal hearings, summary conviction offences, minor traffic offences and accident benefits issues. In Ontario, to become a paralegal, members must undergo experiential training, while also completing a paralegal licensing examination. Paralegals are licensed by the LSUC and are governed by the Paralegal Rules of Conduct.
