Only 15% of Bostonians support retributively killing Tsarnaev. If you picked a random jury to try him, the chance of getting one that would give him the death penalty would be less than one in a billion. Even supposing that whatever details of the trial aren't public would convince anyone not deadset against the death penalty, the odds would be less than one in a thousand.

But prosecutors are allowed to and did select only from that tiny minority for jury members. I guess those willing to kill people are Tsarnaev's peers?

The thing is, I think right now there are not 51 Senate votes in favor of ending the filibuster on legislation, precisely because of the reasoning that I gave: it would be of no immediate practical benefit. You're actually more likely to get the necessary 51 votes at some hypothetical future point when the Democrats control the House.
