💡 3 Steps to a 457 Employer Sponsored Visa

The 457 Visa Program enables employers to sponsor the overseas skilled workers when they cannot find skilled locals for the job. Here are the three processing stages in sponsoring an overseas worker.

★Step 1. Sponsorship - when an employer applies for approval by the Immigration Department as a standard business sponsor.

★Step 2. Nomination - when an approved sponsor identifies a position to be filled. The position must relate to an eligible occupation on the Consolidated Skilled Occupation List (CSOL).

★Step 3. Visa Application - when the overseas skilled worker applies for the visa. A 457 visa cannot get processed without an approved sponsor and nomination.

⚠ Punjab Qualifications Rejected Because of Large Number of Fakes Being Lodged

The Australian High Commission in India has indicated that the Punjab School Education Board (PSEB) Class 12 result has never been recognised as equivalent to the Australian Year 12 qualification but the DIBP is only now enforcing this requirement because of concerns that some results have been found to be non-genuine or not reflective of a client’s academic ability. The pressure is clearly now on for students using the PSEB results to ensure they lodge comprehensive and credible applications to avoid DIBP invoking the PSEB rule.

Popularly known as TR, Temporary Graduate (subclass 485) visa allows individuals to live, study and work in Australia for up to 4 years.

★What is Temporary Graduate Visa?
This visa is for international students who have recently graduated from an Australian education institute.

★This visa has two streams:
👉 Graduate Work Stream - for international students with an eligible qualification who graduate with skills and qualifications that relate to an occupation on the Skilled Occupation List (SOL). A visa in this stream is valid for 18 months from the date of grant.
👉 Post-Study Work stream – for international students who graduate with a higher education degree from an Australian education provider, regardless of their field of study. This stream is only available to students who applied for, and were granted, their first student visa to Australia on or after 5 November 2011. A visa in this stream can be valid for up to four years from the date the visa is granted, depending on the visa applicant's qualification.

★You can apply for this visa if you:
✔ are younger than 50 years old
✔ are currently in Australia
✔ hold an eligible visa
✔ meet the two-year Australian study requirement
✔ have graduated within last 6 months with either an eligible qualification or with skills & qualifications that relate to an occupation on the Skilled Occupation List (SOL).

We have recently received numbers of inquiries from people who were confused about the difference between SOL and CSOL and which visa can be used to apply under different occupation list. Here is the simple explanation for you.

★Skilled Occupations List (SOL) is relevant for applicants who need a visa for:
☑ Independent points-based skilled migration who are not nominated by a state or territory government agency (Subclass 189)
☑ A family sponsored points-based skilled visa (Subclass 489)
☑ Temporary Graduate Visa (Graduate Work Stream Subclass 485)
★Consolidated Sponsored Occupation List (CSOL) is relevant for applicants who need a visa for:
☑ Points-based skilled migration who are nominated by a state or territory government agency
☑ A direct entry stream employer nomination scheme visa (ENS) who must have been nominated by an Australian employer
☑ A Temporary Work (Skilled) visa (subclass 457)
☑ A training and Research Visa (Subclass 402)

⚠ 457 Visa Changes effective from 19th April 2016

👉 Change one: A new 457 Visa Sponsor’s Obligation added
- A standard business sponsor must not engage in, or have engaged in discriminatory recruitment practices during the period of the person’s approval as a sponsor.

What does Discriminatory Recruitment Practice mean?
It means a recruitment practice that directly or indirectly discriminates against a person based on the immigration status or citizenship of the person, other than a practice engaged in to comply with a Commonwealth, State or Territory law.

👉 Change 2: The requirement of English Language Testing has been removed for those applicants who has already been required for registration or occupation licensing.

👉 Change 3: Visa applicants are required to include their nomination details in the application to streamline the visa processes.

Planning on applying for a Skills Assessment from Engineers Australia? Here are some Frequently Asked Questions that may be helpful:

Q. Do I need to provide evidence of my English language competency?
💡 Yes, all applicants are required to provide evidence of their English competency unless the applicant is a native English speaker or have completed at least an Australian Bachelor qualification.

Q. Which English test results can I provide as part of my skills assessment?
💡 IELTS and from January 2016 TOEFL iBT are the only two test results we accept towards your degree assessment. Note that TOEFL PBT and Pearson's Test of English are not accepted towards your degree assessment.

Q. How long is my English test result valid for?
💡 Test result needs to be no older than 2 years at the date of application.

Q. How long is the assessment letter valid for migration purposes?
💡 The assessment notification should not be more than 3 years old at the date of migration application.

Q. I have limited engineering experience. Can I still apply for an assessment of my Engineering qualification?
💡 Yes, you can still apply. Work experience is not a mandatory requirement.

Q. How can I apply for a skills assessment with an unaccredited undergraduate qualification?
💡 You will need to submit a Competency Demonstration Report (CDR) assessment.

Q. I have an Australian postgraduate degree, but my undergraduate degree is not accredited. How can I apply?
💡 Only a few Australian post graduate qualifications are fully accredited and would grant eligibility for an assessment. If you are holding a non-accredited/provisionally accredited Australian postgraduate degree, you will need to apply for a formal assessment of your combined qualifications through the Competency Demonstration (CDR) Pathway.
